The Fresh Prince of Bel-Air star Alfonso Ribeiro on Monday launched a lawsuit against Fortnite publisher Epic Games and NBA 2K creator Take-Two Interactive for their use of his iconic dance.

The 47-year-old actor has claimed that both publishers have used the ‘Carlton dance,’ which he made famous during his time on the American sitcom, without crediting him for it or asking for his permission.

Ribeiro wants Epic Games and Take-Two to stop using his dance move in both titles. It is reported that the In the House star is in the process of having the dance copyrighted.

David L. Hecht, a partner at Pierce Bainbridge Beck Price & Hecht LLP, told Variety: “Epic has earned record profits off of downloadable content in the game, including emotes like ‘Fresh.’

“Yet Epic has failed to compensate or even ask permission from Mr. Ribeiro for the use of his likeness and iconic intellectual property.

“Therefore, Mr. Ribeiro is seeking his fair and reasonable share of profits Epic has earned by use of his iconic intellectual property in Fortnite and as a result is requesting through the courts that Epic cease all use of Mr. Ribeiro’s signature dance.”

According to the Guardian, both Epic Games and Take-Two did not respond to the publication’s request for comment.

Ribeiro first performed the dance on The Fresh Prince of Bel-Air, with his character, Carlton Banks, breaking out into the dance after Tom Jones' ‘It's Not Unusual’ would be played.

He would later perform the Carlton dance alongside Will and Jaden Smith on The Graham Norton Show, as well as busting out the move for ITV’s I'm A Celebrity...Get Me Out Of Here! and Dancing with the Stars.

Fortnite was released in 2017 and has become a worldwide success for the publisher. The free-to-play title is available on PlayStation 4, Xbox One, Nintendo Switch, PC, macOS and iOS and Android devices.

Meanwhile, the latest installment in the long-running 2K franchise, NBA 2K19, was released in September and is available on PS4, Xbox One, Switch, PC and iOS and Android devices.
